Un montant important qu\u2019il est possible d\u2019all\u00e9ger.<\/strong><\/p>\n\n\n\n<p>Lors d\u2019une acquisition immobili\u00e8re, l\u2019acheteur doit bien s\u00fbr \ns\u2019acquitter du prix n\u00e9goci\u00e9 avec le vendeur. Mais il doit \u00e9galement \nr\u00e9gler des frais de notaire, qui repr\u00e9sentent en moyenne 8% du prix de \nvente dans l\u2019ancien, et environ 4% dans le neuf. Cependant, l\u2019expression\n \u00ab&nbsp;frais de notaire&nbsp;\u00bb est largement galvaud\u00e9e. En effet, ces frais sont \ncompos\u00e9s de plusieurs postes, et seule une petite part revient \nfinalement directement au notaire. Le reste rel\u00e8ve pour l\u2019essentiel des \ndroits de mutation, c\u2019est-\u00e0-dire de l\u2019imp\u00f4t.&nbsp;<\/p>\n\n\n\n<p>En th\u00e9orie, les frais d\u2019acquisition, dits \u00ab&nbsp;frais de notaire&nbsp;\u00bb, ne \nsont pas n\u00e9gociables : ils sont \u00e0 r\u00e9gler int\u00e9gralement par l\u2019acheteur, \net le vendeur ne peut \u00e0 aucun moment \u00eatre sollicit\u00e9 pour y participer. \nToutefois, il existe des d\u00e9marches parfaitement l\u00e9gales pour r\u00e9duire un \npeu la note.<\/p>\n\n\n\n<p><strong>Faire jouer les d\u00e9ductions<\/strong><\/p>\n\n\n\n<p>On peut d\u00e9duire du prix de vente du bien la valeur estim\u00e9e du \nmobilier qui le compose. Cela peut concerner une cuisine \u00e9quip\u00e9e, mais \n\u00e9galement des meubles isol\u00e9s, ou encore des \u00e9quipements (radiateurs, \nchaudi\u00e8re\u2026). Dans ce cas, les frais de notaire ne sont pas appliqu\u00e9s sur\n la valeur du mobilier, m\u00eame si l\u2019administration peut parfois demander \ndes justificatifs. Attention : cette d\u00e9duction ne peut g\u00e9n\u00e9ralement pas \nexc\u00e9der 5% du prix de vente du bien immobilier. Mais pour un logement \ndans l\u2019ancien d\u2019une valeur de 300.000 euros, elle peut tout de m\u00eame \npermettre d\u2019\u00e9conomiser jusqu\u2019\u00e0 1.200 euros sur les frais de notaire.&nbsp;<\/p>\n\n\n\n<p>Une deuxi\u00e8me solution consiste, pour l\u2019acqu\u00e9reur, \u00e0 r\u00e9gler lui-m\u00eame \nles frais de l\u2019agent immobilier. Dans ce cas, les frais de notaire sont \ncalcul\u00e9s non pas sur le montant total de la transaction, mais sur le \nprix net vendeur, qui n\u2019inclut pas la commission du professionnel de \nl\u2019immobilier. Seule condition : le vendeur doit officialiser cet \narrangement financier en amont lors de la signature du mandat de vente \navec l\u2019agence.<\/p>\n\n\n\n<p><strong>Une remise du notaire<\/strong><\/p>\n\n\n\n<p>Troisi\u00e8me hypoth\u00e8se : opter pour le neuf. Le futur propri\u00e9taire ne \nr\u00e8gle pas de droits d\u2019enregistrement, mais uniquement la taxe de \npublicit\u00e9 fonci\u00e8re. S\u2019il serait dommage de ne prendre que ce crit\u00e8re en \ncompte lors d\u2019un achat immobilier, l\u2019\u00e9conomie r\u00e9alis\u00e9e par l\u2019acqu\u00e9reur \nn\u2019est pas n\u00e9gligeable. Par exemple, pour un logement dans l\u2019ancien d\u2019une\n valeur de 300.000 euros, les frais de notaire s\u2019\u00e9l\u00e8vent en moyenne \u00e0 \n24.000 euros, contre 12.000 euros dans le neuf.&nbsp;<\/p>\n\n\n\n<p>Enfin, derni\u00e8re option, il est envisageable de choisir un notaire qui\n accorde une remise sur ses honoraires. Bien que ces derniers soient \nstrictement encadr\u00e9s par la loi via un bar\u00e8me, il est possible pour les \nnotaires qui le souhaitent de conc\u00e9der une ristourne \u00e0 leurs clients \ndepuis le 1er janvier 2021. Cette remise ne doit pas d\u00e9passer 20% du \nmontant total des honoraires, et elle concerne uniquement les tranches \nd\u2019assiettes sup\u00e9rieures \u00e0 100.000 euros. Pr\u00e9cision importante : cette \nfaveur n\u2019est pas accord\u00e9e \u00e0 la discr\u00e9tion du client.
